The Consumer Information Association (VKI) has been conducting class action cases since autumn 2018 on behalf of the Ministry of Social Affairs (BMSGPK) and the Federal Chamber of Labor (BAK). EA189 is the trigger for allegations made in 2015 regarding engine control software in diesel vehicles. Against this backdrop, the VKI alleged that the victims overpaid for their vehicles. The long-running legal dispute has now been settled out of court, thus reaching a non-bureaucratic settlement for participants in VKI class action lawsuits. As part of the agreement, a total of 23 million euros will be paid by VKI to the participants in the class action lawsuit.
In 16 cases in all 16 regional courts in Austria – VKI is supported by case funder Omni Bridgeway. The basis for these actions are allegations made in 2015 regarding engine control software in diesel vehicles of the EA189 engine type.
After intensive negotiations, an agreement has now been reached for the VKI class action lawsuits out of court.
Participants in the VKI class action lawsuits will receive a total of 23 million euros. VKI is responsible for executing the contract. Affected participants will be informed directly by VKI about the individual decision and further processing.
